WHAT IS A PARTY WALL AGREEMENT?
Recently planning rules for extensions have been relaxed significantly. However, homes that are extended under permitted development rights will still potentially require a party wall agreement.
An issue with the relaxation is that neighbours may no longer be made aware that proposed extensions next door are going ahead. Therefore, the Party Wall Act is beneficial. A Party Wall agreement ensures that the neighbour doesn’t suffer any damage or loss to their property due to the project.
The Act and the agreement are set in place to help protect neighbouring properties and any problems that may occur when work is carried out.
When Do I Need A Party Wall Agreement?
Before carrying out any work, you must deliver adjoining owners with a formal written notice. This is the Party Wall Agreement. Normally this needs to be done a couple of months before any work begins, one month Is sufficient however the earlier the better.
You can choose to hire a Solicitor or surveyor to do this for you. A good idea is to first discuss with your neighbours what your plans are before issuing the notice. If your neighbours are tenants or leaseholders, you will also need to notify the freeholder or landlord.
Is It A Legal Requirement?
In simple form, yes. If your project includes work on a shared party wall or structure you are required by the law to serve a notice to your neighbours. If you’re slightly unsure as to what kind of projects would require the agreement, here are some examples:
- Building Foundations
- Loft Conversions
- Building Extension
- Adding a basement
- Removing a chimney stack
